Shipping policy

Once the order has been placed, we cannot guarantee that it can be modified if it has already been prepared for shipping. To cancel or modify your order, please write to us at rcdmallorca@futbolemotion.com

We ship internationally to almost all countries worldwide. Select your destination country during the purchase process to see shipping costs and estimated delivery times. Products personalized with a name and/or number have an additional delivery time of 4 business days in addition to what is indicated on the payment page.

Please note the availability date indicated throughout the purchase process, especially in the case of a pre-sale.

Please remember that the prices indicated in the purchase process refer to shipping costs, and not to customs fees (unless otherwise indicated). In the event that a package is held at customs, the buyer will be responsible for paying all taxes and customs duties applied to the package. tienda.rcdmallorca.es is not responsible for customs costs, nor for any delays that may occur during delivery of the package. The customer cannot return their order for this reason, unless an error was made by tienda.rcdmallorca.es

Customs are currently included in shipments to: Mexico, Chile, Peru, and Colombia.

To make an online purchase with in-store pickup, the corresponding shipping method must be selected on the shipping page.

Refund Policy

RIGHT OF WITHDRAWAL

In any case, it will not be possible to exercise the right of withdrawal on:

  1. a) Personalized products do not allow returns or exchanges.

  2. b) Products that after delivery have been handled beyond what is considered normal use to check their normal functioning and are not suitable for resale.

  3. c) The provision of services, once the service has been fully performed, when the performance has begun, with the prior express consent of the consumer and user and with their acknowledgment that they are aware that, once the contract has been fully performed by the business, they will have lost their right of withdrawal.

  4. d) The supply of goods or the provision of services whose price depends on fluctuations in the financial market that the business cannot control and that may occur during the withdrawal period.

  5. e) The supply of goods manufactured according to the consumer and user's specifications or clearly personalized.

  6. f) The supply of goods that may deteriorate or expire quickly (food, flowers, fruit baskets...).

  7. g) The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery (underwear).

  8. h) The supply of goods that after delivery and taking into account their nature have been inseparably mixed with other goods.

  9. i) The supply of alcoholic beverages whose price has been agreed upon at the time of entering into the sales contract and that cannot be delivered before 30 days, and whose real value depends on market fluctuations that the business cannot control.

  10. j) Contracts in which the consumer and user have specifically requested the business to visit them to carry out urgent repair or maintenance operations; if, during such a visit, the business provides additional services to those specifically requested by the consumer or supplies goods other than the spare parts necessarily used to carry out the maintenance or repair operations, the right of withdrawal must apply to said additional services or goods.

  11. k) The supply of sealed audio or video recordings or sealed computer programs that have been unsealed by the consumer and user after delivery.

l) The supply of digital content not provided on a tangible medium when the performance has begun with the prior express consent of the consumer and user and with their knowledge that they consequently lose their right of withdrawal.

HOW TO RETURN MY ORDER?

If you wish to make a return, you must follow these steps:

  • Send us an email to rcdmallorca@futbolemotion.com with your order number and indicating that you wish to make a return

  • Prepare your product in its original packaging

  • Send it to the following address

If you wish, you can also return your online order at your club's store.

IMPORTANT:

  • Personalized products do not allow returns or exchanges.

  • The customer is responsible for return shipping costs.

  • You have a period of 30 calendar days from the receipt of the order to exercise the right of withdrawal without stating a reason. Once the return is requested, you have a maximum of 14 calendar days to return them and receive a refund.

  • If you wish to exchange a product or change a size, you must make a return and place a new order for the new product.

  • The returned product must be suitable for resale. Otherwise, you will not be able to exercise the right of withdrawal and our customer service team will contact you to return the order at no additional cost. Any possible customs fees that may arise during the return process are not included.

GUARANTEES

The guarantee of products offered by Fútbol Emotion through its website tienda.rcdmallorca.es

  1. a) The Product will be delivered in perfect condition and in the requested quantity.

  2. b) The Product will conform to the characteristics most recently indicated by the manufacturer, as set forth on the Website or in the description of the Product materials at the time of placing the order.

SPORTS EMOTION HUB S.L. does everything in its power to deliver products in optimal condition. However, if you receive a product that you consider defective, you must keep it in its current condition so that we (or our agent) can check it within a reasonable period of time. In the event of a defective product, the seller shall proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, actions which shall be free of charge for the consumer and user. The seller is liable for any non-conformity that becomes apparent within three years of delivery. The consumer and user must inform the seller of the non-conformity within two months of becoming aware of it. This clause shall apply taking into account the nature of the product marketed.

To activate the warranty, it is necessary to present:

  • Purchase invoice from SPORTS EMOTION HUB S.L.

  • In all cases, the serial number of the product to be repaired must match the records owned by SPORTS EMOTION HUB S.L.

  • The warranty will begin on the same day of delivery and/or acceptance of the order.
    If, as provided by the Contract, you wish us to repair or replace the Product or refund the amount paid, you must ensure that the Product:

  1. a) Has not been used incorrectly or negligently, has not been handled improperly or carelessly, and has not been subjected to abnormal or harmful conditions. In this regard, the following will not be considered manufacturing defects but rather incorrect uses and/or wear and tear caused by normal use:

A.1) Any personalized product washed with corrosive chemicals.
A.2) Any personalized product washed without following the manufacturer's instructions. Example: Washing above 30ºC.
A.3) Any damage caused as a result of an incorrect size selection.

If the Product does not meet any of the aforementioned requirements, we may decide, at our discretion, not to repair or replace the Product or refund the amount paid and/or we may ask you to reimburse all transport and inspection costs incurred according to current standard rates. To carry out such reimbursement, we may charge the aforementioned costs to your credit or debit card account or use the payment details provided when placing the Order. To the extent permitted by law, we are not responsible for losses, liabilities, costs, damages, or expenses that may result from the process.

GENERAL TERMS AND CONDITIONS OF CONTRACT

These General Terms and Conditions of Contract apply to the contracting of products (the "Product/s") offered to any Internet user who places an order (the "Customer/s") through the website hosted at www.futbolemotion.com and www.futbolemotion.es (the "Website"), owned by SPORTS EMOTION HUB S.L., which operates under the commercial brand FUTBOL EMOTION ® ("FUTBOL EMOTION").

By submitting a request for the contracting of a Product through the Website, the Customer declares to be of legal age and to have the legal capacity to contract the Products offered therein. To this end, FUTBOL EMOTION reserves the right to request, at any time, documentary proof of the Customer's age. In the event that FUTBOL EMOTION verifies that the Customer is not of the required age or the Customer does not respond to FUTBOL EMOTION's request, or does not respond correctly, FUTBOL EMOTION will cancel the sale of the requested Product.

The General Terms and Conditions of Contract apply only to purchases of Products made by Customers through the Website and, consequently, will not apply if Customers purchase products from third parties or in physical stores.

The contracting of Products offered through the Website implies the acceptance of the terms and conditions of the General Terms and Conditions of Contract, so, before proceeding with their acceptance, carefully read their content. If you do not accept the General Terms and Conditions of Contract, the contracting of the Products will not take place and, consequently, will not entail the assumption of any type of obligation and/or responsibility by FUTBOL EMOTION.

Likewise, FUTBOL EMOTION reserves the right to modify the content and/or scope of the General Terms and Conditions of Contract at any time, in which case, it will be duly notified.

Procedures

To proceed with the contracting of the Products, the Customer must be registered on the Website, follow each of the procedure steps provided on the Website, and add them to the shopping cart that will be generated as the products to be purchased are selected. However, shopping carts are not binding for FUTBOL EMOTION or for the Customer.

In subsequent contracting processes, once the Customer has already registered, it will only be necessary to provide the email address and password with which they registered on the Website.

The Customer must make diligent use of the credentials and not make them available to third parties, as well as immediately notify FUTBOL EMOTION of their loss or theft or possible unauthorized access by a third party. Likewise, they must comply with the usage rules provided in this section: https://www.futbolemotion.com/es/informacioncompra/obligaciones.

Price and payment method

The price of the Products will be that which appears in Euros on the Website and will include VAT and/or, where applicable, any other applicable tax and/or fee in the territory of application, as well as, where applicable, any shipping and customs costs duly itemized in accordance with the provisions of the Website:

FUTBOL EMOTION reserves the right to make, at any time, the modifications it deems appropriate to the price of the Products. In any case, the price applicable to the contracting order placed by the Customer will be that indicated at the time of accepting the General Terms and Conditions of Contract regarding the selected Product.

The Customer must pay for the contracted Products using the payment methods provided on the Website. Where applicable, the Customer must include the payment information requested during the Product purchase process.

Subsequently to said payment, the Customer will receive an email confirming the purchase of the Product(s) along with a copy of the General Terms and Conditions of Contract. The Customer may request a physical invoice from FUTBOL EMOTION for the Product contract.

Delivery of Products

Once FUTBOL EMOTION has verified that the purchase has been made correctly, it will proceed to deliver the Products to the address indicated by the Customer during the purchase process within a period that, in no case, will exceed thirty (30) days from the date of order confirmation.

The Customer may track orders through the tool provided on the Website.

The delivery of the Products will be considered made from the moment they have been made available to the Customer.

If the Customer is absent at the time of delivery of the Products, they must contact the courier company contracted by FUTBOL EMOTION or Customer Service to arrange another delivery date.

All purchase orders for the Products are subject to their availability. In case of unavailability of the contracted Product, FUTBOL EMOTION will inform the Client and may offer a product with similar characteristics of equal or superior quality, although the Client may, alternatively, cancel their purchase and recover the amount paid as soon as possible. 

Responsibility

FUTBOL EMOTION strives to offer accurate, complete, and up-to-date product information. Notwithstanding the foregoing, the color of the products shown on the Website may vary depending on the characteristics of the Clients' devices. For this purpose, FUTBOL EMOTION reserves the right to rectify product images when necessary.

FUTBOL EMOTION will not be responsible for any errors that may occur in the delivery of the Products if the Client has not correctly completed the purchase form enabled on the Website. If there is any incident in the delivery of the Products, FUTBOL EMOTION will inform the Client as soon as it becomes aware of it.

The risk of the Products will be transferred to the Client from the moment they have been made available to them, and in the event of their return, they will remain under the Client's responsibility until they are delivered to FUTBOL EMOTION.

Likewise, FUTBOL EMOTION will not be responsible for the breach of any of the obligations arising from the General Terms and Conditions due to force majeure.

Warranties

The warranty for Products sold through the Website will comply with current legislation and, therefore, in general, FUTBOL EMOTION will be responsible for any lack of conformity manifested by the Client within a period of three (3) years from the delivery of the Products.

Specifically, if the Product offered by FUTBOL EMOTION is not compliant, the Client must inform FUTBOL EMOTION as soon as possible via email soporte@futbolemotion.com and follow FUTBOL EMOTION's instructions.

The Client must always follow the instructions of the Customer Service and the provisions in the section "Warranties" to exercise the warranty right.

In case of return of the item due to lack of conformity, the return costs will be borne by FUTBOL EMOTION.

Withdrawal

The Client has a period of thirty calendar days from the date of contracting the Products to exercise their right of withdrawal.

However, the Client may not exercise the right of withdrawal in legally foreseen cases, for example, when it comes to personalized products or those made according to the Client's specifications, and in cases where sealed products are not suitable for return for health protection or hygiene reasons.

To exercise the right of withdrawal, the Client must complete the Withdrawal Form[2] and send the Product to be returned to FUTBOL EMOTION along with all packaging.

Once the right of withdrawal has been exercised and, in any case, within a maximum period of thirty calendar days from the date of receipt of the Product, FUTBOL EMOTION will make the payment to the Client corresponding to the full amount of the Product purchase and, if applicable, the delivery costs.

Without prejudice to the right of withdrawal provided above, FUTBOL EMOTION accepts the return of Products in accordance with the provisions of the Returns Policy.

Personal data protection

In relation to the personal data provided by the Client during the purchase process of the Products, FUTBOL EMOTION, as the Data Controller, will process them for the purpose of managing the sale and delivery of the Products contracted through the Website, as well as, if applicable, to send informative communications to the Client through personalized automated analyses.[3]

The Client may exercise their rights of access, rectification, erasure, or others, by sending an email to protecciondatos@futbolemotion.com.

Complaints and claims

The Client must contact FUTBOL EMOTION, through the means indicated at the beginning of the General Terms and Conditions, to submit their complaints and claims. FUTBOL EMOTION undertakes to provide them with the complaint form to address them as soon as possible and, in any case, within one month from their submission.

Nullity

If any of the clauses of the General Terms and Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will only affect that provision or the part of it that is null or ineffective, and the others will remain in force, with such provision or the affected part of it being considered not included. For these purposes, the General Terms and Conditions will only cease to be valid exclusively with respect to the null or ineffective provision, and no other part or provision of the same will be annulled, invalidated, impaired, or affected by such nullity or ineffectiveness.

Applicable law and jurisdiction

The General Terms and Conditions will be governed and interpreted in accordance with Spanish law.

In accordance with art. 14 of Regulation 524/2013 of the European Parliament and of the Council, of May 21, 2013, on online dispute resolution for consumer disputes, the Client is informed that they can submit their claims to the dispute resolution platform available at the following link: http://ec.europa.eu/consumers/odr/  

Likewise, in the event of any conflict or discrepancy in the interpretation and/or application of the General Terms and Conditions, the competent Courts will be those provided by the applicable regulations on competent jurisdiction in consumer and user matters.

The Client accepts the refund of the amount paid at the time, without interest, through the same payment method used.

[1] We have seen that a surcharge of €2.99 is foreseen if payment is made via "Cash on delivery". It should be noted that Article 60 ter of RDL 1/2007 states: "Charges for the use of payment methods. 1. Businesses may not charge consumers and users, for the use of certain payment methods, charges that exceed the cost borne by the business for the use of such methods."

[2] We recommend enabling an online form according to the model attached at the end of the General Terms and Conditions (see model at the end of the GTC).

[3] The existence of "automated decisions" (decisions based solely on automated processing without human intervention), including "profiling" [3], requires informing about the applied logic, as well as the importance and foreseen consequences of such processing for data subjects; likewise, we should enable specific consent in this regard that could be included in the purchase procedure when the GTC are accepted.
